I live in California and have had a judgment for 20 years because of a broken car lease. I lost the case by default (was in the court room but didn't know that an answer had to be filed prior to court day). The original judgement was for ten years and it was renewed for 10.

My question is if I sell my home would they be able to collect? The other scenario is when my Children inherit the home through a trust would they be liable?

Hi dbentrum,

If there is a lien on your property due to the broken car lease, then you will be liable for paying it off from your sale proceeds that you receive after selling the property. If the lien has already been placed on your property, then your children will have to pay it if they inherit it.

The judgement is a personal not a lien on the property. On someone's else's post here they were told that a car loan was an unsecured loan and the creditor couldn't come after the property?

Welcome Guest,

A car loan cannot be considered as an unsecured loan. The loan is secured by the car as it has been used as a collateral to get the loan.
