My wife died intestate in CA and we owned the house in Joint Tenancy. The house was mortgaged but in her name only. I know I take "subject to" the note, but do I have to refinance or can the note be switched to my name?

Hi Markf!

Welcome to forums!

As the mortgage was only in her name, I think you will have to refinance the mortgage because you are the new owner of the property now. However, you can check with the lender if he allows a novation. But as far as I know, the lenders prefer refinancing.
