Hi Joshua,

my mom who is a non resident alien is planning to buy a mobile home in california & let me & my wife live there. she would like to gift me the mobile home and wants to maintain it as a separate property for me. however, it is a mobile park requirement that the title should also include my name on it so i can live in the park. will it be considered a community property? can my mom also file a quit claim so she can gift me the property?

Hi lvcp!

Welcome to forums!

As you're married, your spouse will have community property interest in the property if your name is added to it. Your mother can file a quit claim deed and gift you the property. If you don't want your wife to have any interest in the property, then you should ask her to sign an inter-spousal transfer deed and give away her rights to the property.
