Hi herrerareyna,

Welcome to the forum.

If you have signed a agreement that says you have no claim on the property, then you do not have any rights on that property.

BTW you can do a title search to be sure if you are on the property still now.

Hi herrerareyna,

If there has no transfer of property between you and your spouse even after filing divorce, then you stilll have the rights to the property and hence the equity. Only after the divorce is final, the property will be distributed as per stated in the divorce decree.

By the way, have you claimed any rights on the property? if you haven't then the distribution will be made as per the court decision. However, this is applicable only if the divorce is being done through court procedure and not mutual understanding.

You may consult a divorce attorney in California for further information in this regard.

As I understand it unless there was a prenup or some kind of written agreeement with regards to the house then the terms of divorce are still negotiable including the house. Im no expert though your best bet as jameshogg says is to conult a divorce attorney.
