My father died in ca. intestate in 2007 and left a small estate under 100,000. Bank of America has requested a court approved quick claim for the funds in his business checking. My understang is all that is necessary is the terms under pc 13101.

Welcome dkfoust,

If your father had a debt with Bank of America, then they can come after your father's estate in order to recover the debts after his death.

Thank you for your response! I have spoken to B o A consumer activitest from the CEO's office regarding the post. Was informed the line of credit my father had with B o A was an unsecured line under another companies name that my father had no knowledge of or business with. B of A through this line has taken $52,000 in payments and has asked for more time to investigate!They have had 4 years so far. No Probate has been opened by B of A or anyone.
