Quitclaim deed transfer from a death (California)

Ten years ago a non-relative with no children had quitclaimed a property to me in the event of her death. I'm not particularly savvy on these sorts of things, but the deed was notorized and for as far as I am told, was done correctly.

Now I have been urged to go claim this property, but I never thought to ask for a copy of this quitclaim. I was given the name and number of the lawyer who she did this through and I have the address of the property, but I don't know where I should go to see about this. I do not have the actual quitclaim deed in my possession and never have, I simply was shown it years ago and went about my business for the past ten years. Do I need to obtain it somehow? How would I go about this?

What is the process? Is there an urgent time limit on which I should be operating in order to gain the property? It has been less than a year, but several months since her passing - I really don't know where to start.

Hi ryansaltzman,

I hope the deed was recorded at the county recorder's office where the property is located. You need to contact that county recorder's office and get a duplicate copy of the deed. Once you get the copy of the deed, you will be able to claim the property.

I want to hand over my property in Oakland,CA to my brother. It's all paid up but I'm unable to maintain all the excess work & expenses needed on it. What is the easiest, least economical, legal way to do this?

Hi Silvy!

Welcome to forums!

As the property is free and clear, you can use a warranty deed to transfer the property to your brother. It is a legal a document transferring property from one person to another. It would be better if you could take the help of an attorney to draft the deed.
