I live in california and bought my home befor I was married, I am now refinancing and my husbands name is not on the loan and has never been on the deed but the bank wants him to sign a paper relinquishing his right and saying that the grant deed will appear only in my name. He thinks that this will make him responisble for the loan if something happens

fmommie3,

california is a community law sate. Therefore, Your home will be considered as a marital property & your husband as well will have stake in it.

That is the reaon bank is asking him to sign. Actually it is good for you

i don't understand why it is good for our poster if her husband signs away his rights. are you contemplating them splitting up, mark? i'd have to note that our poster never said anything of the sort.
