I live in California and my domestic partner and i are splitting. We purchased a house in 2005 with me as sole borrower and her on title only - as joint tenant. She wants to move back home and I am willing to ride out this crazy mortgage mess. Our house is now worth 1/2 of what we purchased it for and I am willing to take on the full responsibility of the debt. However, if I can't and I have to foreclose, i don't want her to be responsible for the debt. If she quitclaims herself off the deed does that also clear her of any responsibility regarding the debt (especially since she was never part of the actual loan)? Or, do we need to file a warranty deed? Finally, should I do this through a law firm or can i easily obtain the forms and file them myself? Thanks.

Hi bircluc,

As she is only on the title and not on the mortgage, she can simply quitclaim to get rid of the mortgage. You can do it on your own, bu I would suggest you to get assistance from an attorney to avoid any trouble in future.
