As far as I know, in a community property state, all property acquired during or after the marriage is considered as a community property and is divided accordingly in case of divorce or death. I think your name was not added to the property when the refinance took place. Did you sign an inter-spousal deed when the refinance took place? If not then you can claim your interest in the property if you are making payments towards the mortgage. However, I would suggest you to speak to an attorney regarding this issue and get it cleared.
