removing a name from deed/title in CA

Though the mortgage is in my name, my partner and I are both on the deed and/or title of our home in California. I'm not sure which, or whether it's as a "joint tenancy," is there a way for me to check this? I still have all my papers from the purchase.

Now he wants to buy his own home, but the loan he wants requires him to live there as his primary home w/ no other homes owned. Since I technically own this house, and only added him to the deed/title since he was living with me, is a quit claim the only thing I need to do in order to clear him of possession of this house so he can purchase his own home?

Also, if my home were to be foreclosed on, would his credit be messed up as well, or only the person listed on the actual mortgages?

Hi Kate H,

To know more about the title of the property and whether it's a joint-tenancy, you can do a title search with the land registry office. Since you say you added your partner to the title, his name should be on the title. To remove his name from the title, all he needs to do is to sign a simple quitclaim deed to you transferring his share in the property to you. Thus his name will get cleared of possession of the house and he could then buy a home of his own.

After he quitclaims the property to you, if the property is foreclosed, it will not affect his credit score, as the mortgage is in your name, not in his name.

I want to add my son's name to my house not the mortgage, so that if I should pass away, he could take over the property. Are there any bad implications for my son in doing so? If so, what are they? Also, do just quitclaim him on to the deed, or is there more to it than that? Living in California...

Hi Brenda,

If you want to add your son's name to the title, you can do that using a quit claim deed. You can quitclaim it to you and your son so both of you remain on the title or you can quitclaim it to your son only. ther are no bad implications for your son in doing so.
