When I married I owned my house,I put him on the deed and he refinced the house to pay off bills and get a town car,after 7.5 years we are getting a divorced and now i am stuck with house payments of 1186 a month.. In California, is this right ?

Hi janisback,

If your name is not mentioned on the mortgage loan, then you're not personally liable for the mortgage. However, if your name is mentioned on the mortgage and the property, then you will be liable for paying of the loan to the lender.

Hi,

It is so sad to hear that you are getting divorced. Are you still the one paying it right now? You know what, I agree with jameshogg that if you're name doesn't appear on the the mortgage then you don't have direct liability for the said mortgage. It would be your prerogative then if you want to save the property.
