My brother-in-law signed a quit claim, early last year for the house and property that was jointly owned with my sister. My sister died in December. They were llegally married for 20 years in the state of Colorado at the time of her death. How can he get the property back in his name. Does it automatically transfer back to him since he is the spouse of the deceased grantee?

Did they ever record the Quit claim Deed in the county?

Hi Barb,

Your brother-in-law will have to file an affidavit of heirship in the county recorder's office and transfer the property in his name.
