United Cash Loans scaring enough!

Posted on: 27th Aug, 2007 02:13 am
I've defaulted on my payday loan and now United Cash tells me that they're sending police to get me arrested. Is that what they will really do or just threatening me? I'm already working with a credit counseling agency and trying to pay them. It's a month ago that I sent them the first late payment check even. But here I'm really troubled, can they call the police??
Quick payday loan said I defaulted on a loan in 2005. Can they still tell me that I owe over $3,000.00 and have me arrested if I do not pay this. They will not send me any paper work to show me that this is a real loan.

Hi Cindy!

It is your right to see the papers. You can force them to show you the papers. In this case, you can also take legal help.

If you have really defaulted a loan, then they can come after you anytime and tell you to pay it off. I don't think they will get you arrested but yes, they can definitely place liens on your property.

Thanks,

Jerry

dorothy, eric said it more than 2 years ago, and it's still true. you cannot go to jail for simply owing money. what you need to do in this case is be in contact with the federal trade commission (you can go online at ftc.gov) and give them the phone numbers you just noted above. what that man told you is against the law, and he ought to go to jail for it. he won't but the government can fine his company for those remarks. you have protection against foolishness like that, and you need to exercise your protection. please take this step so people like him can be driven out of business.

what he told you was wrong, and what's worse is that it was downright nasty.

I got a loan for 400 dollars and my bank charged my a unreasonable amount of over charges for less then 20.00 . That caused me to go in to 250. In over charges so I closed my account it's only been 4 days and I got a call from the lender saying in was in the hot check
Department . But I never
250

Guest, I know it's difficult to try to describe what happened here, but try a little harder, please, to make it easier for us to follow. Are they accusing you of passing a bad check? Did the $400 loan check bounce? I understand that the charges on your account caused you to owe them $250...that much I get.

Unfortunately you stopped after a while with no real question asked. I suspect you owe the bank where you have your checking account $250. I also suspect you owe someone else $400 for the loan you took.

The best thing to do is to find the funds to pay these two amounts and move forward from there.

If I've erred in trying to figure out your dilemma, please let me know.

I also made the mistake of going to a few cash advance this past summer. After about 3 months of paying i noticed my loan wasn't getting paid at all it all went to fees. So i decided to call one of the lenders and they told me my 200.00 loan is actually 1200. so after some thought and getting some legal advice, i decided to file chap 7. Well i have not paid the lawyers just yet. at the moment I'm working 2 jobs and trying to catch up on other bills that is more important like utilities and rent. I have 3 young children and i was left with no choice but to file. Well about a month ago my lawyer advised me close my checking account so they wont take anymore money out. Just yesterday i got a phone call from one of the lenders lawyers and she told me i cant file bankruptcy and they are suing me for fraud. I called my lawyer and he told me not to worry but i cant stop worrying about this. Can someone please give me some advice on what to do.

Hi Guest!

Welcome to forums!

If the payday loan companies are not legal in your state, then they cannot file a lawsuit against you. You should contact your attorney and take his opinion as to what steps you need to take in this regard.

Feel free to ask if you've further queries.

I did do some research and this is what i found out.

A payday loan, also called a deferred deposit, is issued when a financial institution (a payday lender or check cashier) agrees to provide cash in the amount of the customes next expected payroll check for a fee. These short-term loans are required by state law to be paid in full before another one can be issued, and customers may not have more than two payday loans totaling $500 at a time. Internet payday lenders are not regulated in the state of Kentucky and are therefore illegal.

I also went to 4 lenders so I'm not sure if i will get in trouble for having more than the legal allowed which is two. I do live in Ky and it stats that it is illegal so this helped out a lot, now i don't have to worry much. Thanks again!

Needing help, I'm not sure what you meant by saying you went to four lenders..was it simply to shop, or did you acquire loans from all four? That it's illegal might make one think that they wouldn't exist to begin with, but if they're there, I suspect they'll be able to enforce their loan(s) with you.

"State law" depends on what state you're speaking of, naturally. Not every state allows such loans to be offered.

They cannot arrest you that easy. If they want to get you arrested they will have to take certain measures like filing a case against you.
