In 2008 I filed for Bankruptcy. Although I never included my home in the BK, The Bank of America reported to the credit beuarus that I had included it. Now that the BK has been discharged. Although they continue to accept my house payment every month. they also continue to report my home as being discharged in the BK. Upon contacting The B of A I was informed that because my Attorney never filed a notice of reaffirment with the bank. Therefore they can continue to report the house as being discharged although it is not true.
Isn't this a violation of the Fair Credit Reporting Act? Is there any way of getting them to remove negative mark on my credit report?

Hi strawdog,

As the mortgage was not included included in bankruptcy and was not discharged, the lender cannot report the same to the credit bureaus. You can contact the credit bureaus and discuss the matter with them.
