2 months ago I informed transunion through letter about collection a/cs I want to dispute & requested for validation with details about why the accounts do not belong to me. I also stated fdcpa details in my letter about it. I also asked for copies of signed all the signed contracts and stated that I had sent the same letter to all the collection companies holding the accounts. Just few days back I got a letter from the bureau that said my claim was irrelevant and the account was verified. My question is why my claim was disregarded as being irrevalent/wrong? _________________ Need help choosing the right loan? Get free consultation from community lenders/consultant |

Hi Hoft,
Welcome to Mortgagefit discussion board.
Credit bureaus do not have copies of the signed contract you had with the company. If you are disputing any entry on your report with the bureau, what they do is forward it to the collection agency who is reporting it to them & ask them to verify whether the information which is reported is correct or not.
If the collection agency verifies to the bureau that the information they have given them is correct then bureau is complying with the fcra norms and cannot do anything else about it. What you need to do is send certified letter to the CA and ask them to provide you the actual signed contract. They do not do so then you can claim that they are violating the provisions.
Do let me know if you have any other questions.
Thanks

thanks for the reply but one thing I like to know is, isn't bureau to verify what the collection agency tells them about the account? _________________ Need help choosing the right loan? Get free consultation from community lenders/consultant |

Hoft, the credit bureau only passes the dispute you place to the collection agency reporting the information. If CA does not reply within thirty days then bureau has to delete that account from your report. But if the collection agency does reply back to the bureau that information reported is correct then it will remain on your report.

I would also say that when you are disputing any entry on your report, bureau only forwards it to the data provider.
After receiving the dispute ca has to investigate, review all relevant details that a customer has provided and report result of their investigation to the bureau in thirty days time. And also update or correct any wrong information that is found.
If you think the ca is not reporting actual information then you can file lawsuit on this basis.
In the court they will have to prove that information they are reporting is correct and if they cannot then you will be able to have the information removed from your report. |
