James , can they garnish my wages if I am self employed? Also the house is in my mothers name but it is her property the butane tank sits on and was used by me in the house. Can they put a lien on the house? Also what is the worst that can happen to me besides garnish wages or lien on the house? What happens if I do not show up, they have no information on me?

Hi Brysonite!

Welcome to forums!

If they file a lawsuit against you and file a judgment, then they will be able to garnish your wages. If they get a judgment, then they will be able to even place a lien on your house. If you do not show up in the court, then your creditor will get a default judgment against you.

Feel free to ask if you've further queries.

If they get a judgment on me can they place a lien on my mothers house that I live in? If they can does this mean the judgment stays on the house until it is sold or can they make me sell the house to satisfy the lien? Thanks

Welcome Brysonite,

If the property is not in your name, then your creditors won't be able to place a lien on that property. Your creditors will be able to place a lien only on your property after they get a judgment from the court.

I was in the process of selling my home come to find out my husband had 2car reposession and it is showing as a lien on our personal property the liens together are almost 40,000 due to interest rates? What do we need to do, now we cant sell the house and property together because of the liens on the land

Hi Renee,

Unless the liens are paid off, you won't be able to sell off the land. Once you pay off the liens, you will get a lien release certificate from the lender and then you can sell off the land.

Thanks

Hi cjb,

You may be able to place a lien on them provided you file a lawsuit and receive a judgment against them from the court.

Thanks

Hi dottieyoung!

Welcome to forums!

Unless they correct the problems, I don't think it will be a good option to pay off the dues. Nevertheless, have a word with an attorney and take his opinion in this matter so that you can decide what steps you can take.

Feel free to ask if you've further queries.

I want to file bankruptcy because I lost my home to foreclosure. My mom is planning on buying me another home that is foreclosed for $25,000. Can I put the house in my name or do I put it in both our names. Can the creditors take this home that my mom is going to buy me and can I purchase this home during bankruptcy. Someone please help

Welcome Sara,

It will depend upon your mother and you whether or not you will be put both the names on the property deed. Moreover, if you owe money on the foreclosed property, then there are chances that the lender will come after your new home if you include your name on the deed.
