I think it is 3, for sure, 90 days is a foreclosure notice and then at 4 they start acting on it for sure.

Went through this when I first got my home. Month after we bought it the mortgage comp. sold to another. never registered our payments for months. They contacted us somewhere between third and fourth month. We cleared it up but of course I was totally annoyed.

Foreclosure comes into play between the 3rd and 4th payment missed, they will normally try to get you to make 3 of the 4 payments and let you take the time to catch up the 4th. It is not in their best intrest either to let you lose your home. Most companies have programs in place that will assist you, but you should contact them immediately instead of waiting until you are this many payments behind and you are in real danger of losing everything that you have worked so hard for.

I just seen a news story the other night where middle class people who lost thier homes were living in their cars, there are places that actually open lots that are gated for these people to move their vehicles and sleep the night through safely. They are brushing their teeth and cleaning up in public restrooms, such sad stories to hear and watch. Makes you wonder how people end up in these situations. Some of the stories are familiar while others are not so familiar, but every one of them breaks my heart. Seems like some people were not dealt a fair shake when they were first offered the mortgage, payments and intrest sky rocket and they can not afford them. I really hope this mortgage industry shapes up soon.

I pity anyone who is in this situation, these people that fall for these flexible rates are victims in some of these situations, they get the loans with really low rates and in a matter of a year, they are paying a payment that they can not afford, invest all the money and lose it all. Hopefully things will look up soon.

Those flexible rates can definately be a killer. I have seen people lose their homes due to rates sky rocketing. You can very easily go from a small payment to one that is three times that amount.

Welcome INDAR.

Has the chapter 13 dismissed or "DISCHARGED". If you you pay it off then you will be discharged. But chapter 13 cannot be discharged within 30 days after filing. So you need to clarify it first.

I think you are right here, Jbarto. I really do not see 2 payments could affect someone this much. I would think about 8 payments or so would be more likely.

Thank You for the Reply. The Chapter 13 has been dismissed because of no follow through by the filer within 30 days.

Hi indar.

Bankruptcy dismissal doesn't affect your credit report much. If there is any effect for bankruptcy it is actually very negligible as you have already faced the hit of bankruptcy.

Feel free to ask if you have any further questions.

Best of luck,
Larry
