bankruptcy dismissal

my bankruptcy was dismiss last year because we had file already and our years wasn't up to refile. can you tell me how can I get this off my credit report asap it is stopping me from buying everything please help

A bankruptcy dismissal is a negative item and will remain on your credit report. You won't be able to remove it from the report. However, if 3-4 years have passed since you've filed for your previous bankruptcy, then you will be able to get a loan provided you satisfy the other required criteria of the lender.

we were dismissed ,because of not having all documents available. Can we refile with the same law firm. Will we have to start from scratch?

case was dismissed with only two months to go due to falling behind in payment. payment mailed on 28th received dismisal notice on 2nd, will trustee refund this payment? also house portion was all paid up and current will bank still try to foreclose now that dismissed?

Hi annonymous,

I don't think the trustee will refund the payments. The payment may have been disbursed amongst your creditors. If the house was paid in full when you were in bankruptcy, then it means that you will be able to save the property.

Will/can my case be dismissed if I turned in my tax returns papers late to the trustee? he/she does get it, is it to late for it to be filed before the discharge date?

Hi Guest,

It will be better if you could provide your tax return papers on time. If you don't provide the tax return papers on time, then your bankruptcy filing may get dismissed.

I have 6 months to go in my bankruptcy, 6 months ago my husband was told he has stage 4 cancer, we fallen behind on everything even the trustee payments. My lawyer says their nothing they can do, what happen if it gets dismissed?

If your bankruptcy filing gets dismissed, then your creditors and lenders will be able to come after you in order to recover the debts.

want to know if after my dismissal ,will i be able to keep my house,and car if i continue my regular payments.[ i just owe $4300 on my home}and now we can afford our monthly payments.the reason of my dismissal is due to that my payments are to high and im behind 2 months

After the bankruptcy dismissal, you will lose the bankruptcy protection. So, you should immediately start off with the regular payments. If you do so, then the creditors won't come after you.
