DV letter and 30 days time period

I had sent a DV letter to a collection agency who is trying to collect on a debt I do not owe. 30 days will be over by tomorrow and I have not received a response. But I have heard that you need to write the letter within 30 days of receiving notice of the debt. So, will my letter be even considered as I didn't send it within 30 days time period? They just marked it as investigated and left it on my reports. I am wondering if I am just stuck with this negative item on my report.

As far as I know, the CRA has to investigate and answer the dispute within 30 days. This is irrespective of when you send the dispute. As far as the debt validation is concerned, you will have to request it within 30 days of their initial communication with you.

Welcome Welham,

You will have to wait and watch whether or not the CA validates your debt. You can then send them a cease and desist letter and ask them to stop contacting you. In case they don't validate the debt, you can contact the credit bureaus and ask them to remove it from your credit report. If the CA has anything else to say, he will contact you again.

Debt validation has offered you the rights to dispute any debt which you feel is unjustified. Under the Fair Debt Collection Practices Act (FDCPA), you can validate or dispute the debt within one month of receiving formal communication from the collection agency.
