According to the Credit Repair Organizations Act (CROA), a person meets the statutory definition of a "credit repair organization" if it "uses any instrumentality of interstate commerce or the mails to sell, provide, or perform (or represent that such person can or will sell, provide, or perform) any service, in return for the payment of money or other valuable consideration, for the express or implied purpose of improving any consumer's credit record, credit history, or credit rating."
It should be noted, that any person or entity that engages in the above activity "for a fee" even one time is required by law to abide by and provide disclosures, right to cancel, specific contract language requirements, the advance payment prohibitions, etc.
There is a separate issue, aside from the above CROA requirements and that is access to credit reports. The CRA's will not allow a credit repair organization access to credit reports and as such a mortgage company or automobile dealership that provides credit repair will find its credit reporting access terminated.
