i have been paying the house. can't refinance my credit is not that good.

Have you consulted with any lenders? Is it that they have said that you cannot refinance because of your law credit? Please give a bit more details as George has mentioned above.

yes george it is important to know how bad is his credit.

mp77ma, looks like you want to refinance and remove ex-spouse from the deed because he's not paying. So, use a quitclaim deed for the transfer of property. For refinancing with poor credit , please refer to the previous discussion on this topic.
