My sister owns a house and her husband is not on the deed. He wants to share ownership with his wife. How does he go about doing this?

depends on the state, and depends on what he's planning on doing.

if he's planning on refinancing...they can put his name on the deed when they perform the loan. if he just wants his name on the deed ...he will need to do a quit claim deed with any real estate attorney or title company.

some states automatically give 50% ownership to the spouse because of their state laws

Hi,

If he wants to get his name added to the title of the property, your sister has to sign a quit claim as the grantor with her husbands name as the grantee.

Hello Sounique,

Your sister has to do a quit claim to add her husband to the deed. The quit claim has to be notarized and recorded at the county office in order to make it valid.

The quit claim will not transfer any financial liabilities. So, if your sister has a mortgage in her name only, it will still remain the same and her husband won't get added to that.

Hi Sounique,

Welcome to this Forum.

If your sister stays in a community property state, then her husband will gain 50% ownership automatically after the marriage as per the state law. And if it is not a community property state, then your sister has to sign a quitclaim deed to transfer 50% ownership to her husband.
