Yeah, some bucks for me, a big fat law suit if they use dogs to try and collect a debt from me, I can not even image that, they must be studpid, they can not by law use these tactics.
I just wish these companies that harass you would all together go away. I mean why can't the original creditor sell us our own debt or settle our debt for pennies on the dollar? It would put an end to stupid collection tactics.
Well fireyone, I wish the creditors could settle the debt so easily but that's not the way actually. It's done through the collection agency mostly and that's how it goes.
I am just glad I only have one to deal with. I'm going to get my health back on track and do everything I can to work long enough hours to get rid of it. It is past SOL but I still don't want the harassment or it to linger on my report.
Probably a good way to deal with it fireyone, they will continue to harrass long after the statute of limitation. You can always write a cease and desist letter to them and hope they will abide by the law and leave you alone. goodluck hope you get this one cleared up soon and hope your health continues to improve. keep us updated.

They would probaly sell it the day after the got the cease and desisit. Then the next ca would start. seems tol be repeating past history. Got trigger point injections today...see no difference except heighten pain level but it should start helping after a few days. Forever the optimist.
Oh you mean the collection agency will sell off the debt to another the day after they get the cease and desist letter and again the SOL would start! then what does a debtor do if he cannot even object to harrassments by the creditor/collection agency?
Sorry Jer I forgot to sign in on that last post. I think you misunderstood me. What I meant is I would send my current CA a cease and desist letter and since they legaly couldn't contact me anymore I figure they would sell my account off to the next CA. They would start calling and I would have to send out another to the new one. This could go on for years. I have read where some people recieve calls on 20 year old debts. The SoL remains intact UNTIL you make a payment. Once you send in any monies it restarts the SOL..other than that it doesn't restart.

I may be wrong but what you're trying to say here is, if you send the cease and desist letter to your collection agency, they will perhaps sell off the debt to another agency and then when the latter starts calling, the SOL is likely to start over again. The statute of limitations will not start over again unless you make a payment, you need to go to the fair debt collections webpage and read the information there that is posted about statute of limitations.
Does not matter how many collection agencies pick it up or buy it, does not matter if it is fifty years down the road, the statute of limitations goes on the last payment activity.

You got it Jbarto. That is exactly what I was trying to point out. I was also trying to explain that one the CA gets the c&d letter more than likely they will unload the debt to another CA and the attempts to collect on the debt (phone calls) will start over (not SOL) and they will have to send the next CA a cease and desisit. Tha nks for helping clear that up.
No I think they sold it again. No crap. Now some place called LHR is calling. They are a collection service cause I looked up the number. Problem is I never know if they are for me or the other people that owned this number before. Either way if I pick up they just take that as a sign I want to be aggravated. I have way too much on my plate right now.
