Hi Therese,
Welcome to MortgageFit Forums.
First of all I want to congratulate you on your marriage. You can add your husband's name through a quit claim deed.
You will find a quit claim deed form at any office supply store. You can also find one here which you may download for the purpose.
But do get an attorney to guide you in the process and also get the deed notarized after it is filled up.
God bless you.

Hi Therese,
I want to provide you with some additional information which I think might help you. You should fill up the form with black ink or should get it typed, signed and notarized.
After it is notarized, it should be recorded with the recorder's office. It may cost you $14.00 for the first page and $3.00 for each additional page of the document in order to record the deed. |

Therese,
A Quit Claim to modify the title of your property is a legal document that, in my opinion, should not be taken lightly.
I assume you desire to modify your title so that if something where to happen to either you or your spouse, the surviving spouse will have instant rights to the property without having to go through a legal proceeding to prove or acquire these rights. Given the importance of this matter, I cannot with good conscience recommend using an office supply or generic Quit Claim document to complete this task.
How you modify the title is a very important legal issue (ie: Joint Tenancy vs. Tenancy by the Entirety). The risk of having this recorded document not accomplish your ultimate goal due to a possible technical/legal issue is not worth the savings of using a generic form.
Quit Claims should be written for your specific situation, goal, State of residency, etc., etc. This should always be done by utilizing the services of a reputable real estate attorney. The cost is usually no more than a $100 including filing fees and you will have the peace of mind knowing that your home’s title will do what you want it to if something ever does happen to you or your spouse.
Best of Luck! _________________ Bill Clanton is a Mortgage Specialist and Manager of State Street Mortgage of Illinois. StateStreetMortgage.Net |
