Hi Pauline,

If you are the grantee, that means you become the owner of the property. You would be responsible for paying the property taxes and other utility bills. If you are thinking about gift taxes, then you won't be responsible for it. The grantor of the property will have to pay gift taxes if the property has been transferred to you as a gift.

In some states a quit claim deed can be reversed by a judge if the grantor is listed as both the grantor and grantee (basically adding someone to the deed rather than transferring complete ownership rights). The circumstances in which a judge may reverse a deed are if the deed was signed under threat, cohersion, or by misleading statements and facts. In these cases, a judge will require proof and may consider having the deed reversed. it is rare , but possible depending on the state. I would contact a lawyer and your local county clerk.

my husband and I are separated i signed the deed over to him for refinancing the home , he told me he would put the house into a trust for our children . I currently live in the house and pay the mortgage, now he is threatening to kick me out and sell it. what are my rights if any? thank you

Welcome Lisa,

As your name is not mentioned on the property deed, your husband will be considered as the sole owner of the property. He has the rights to ask you to move out of the property.

I signed quit claim papers under duress giving my home away but was 6 or 7 years ago. Can I get back or get portion of money for my half

You will be able to get back your share of the property if you could prove that you were forced to sign the quitclaim deed. You should immediately contact a real estate attorney and take his opinion in this matter. He will guide you so that you can file a case and get back your share in the property.

Once a quit claim deed has been filed or completed is there a waiting time to reverse it ? the mortgage co. is requesting the quit claim, to take my name off the property as the other person is trying to get a modification on the loan, if I do sign the quit claim can it be reversed, the attorney handling the case yes, easy to do & easy to reverse !

The quitclaim deed can be reversed provided that the other person is ready to sign a new deed and add your back to the deed.

My husband's uncle quickclaimed his home and property to my husband and myself 3 years ago. We had been taking care of him for over 5 years. My husband held his power of attorney until his death (my husband) 2 weeks ago. His cousin has now decided to take power of attorney which is fine but she is also trying to reverse this quickclaim on the house. We filed and it was recorded in Cass County, Missouri. I am not sure of statue of limintations on this sort of thing. Can she do this?

Hi Guest,

The power of attorney will not longer be valid after the death of your husband's uncle. The power of attorney is valid only when the person is alive. If the quitclaim deed has been signed and recorded, then it can't be reversed without your permission.

I am in a simular sitution where while under duress due to a forecloser I signed over the title to my house (the mortgage is still in my name) in what was to be a cash for keys deal but the investor never lived up to his financial obligation. Then we were to do a short sale and again the investor lied to me. This to me seems wrong and like fruad. How can I get it back in my name?

You're in a tough situation. It will be better if you could contact a real estate attorney and discuss your case with him. The real estate attorney will help you file a lawsuit against your investor which might help you in getting back the property.

There are wasy to reverse a quit claim deed , depending on the state. For instance if you signed under duress or under the infulence of drugs or alcohol... and have pproof of this you can get your property back.... YOU have 7 years in Florida for example to file les pendens to get it reversed... It must also have 2 wittness signutures in Fl.. check your state statutes on this topic.

while married, my ex and I quit claimed our ranch to one of our sons. ex, now wants to take our son to court to make him reverse the quit claim back to him

Hi Guest,

Your ex cannot force your son to sign the quitclaim deed. However, the court may ask your son to reverse the quitclaim deed if you ex can prove that there was some kind of fraudulent activity involved while transferring the property. Your son should consult a real estate attorney in this matter.
