Will grantor lose rights on property after quit claim?

The family member wants to pay the forclosure fees, that is, fee which the lender asks for to cover the costs he incurred for initiating foreclosure proceedings. But I don't know how much beneficial will it be if your friends take our property and pays your mortgage in 3 years..please don't mind as the guy is your friend but I have to say that this looks like foreclosure rescue scam!

We own a building that has been used by a church, last year we quick deeded the building to the church, however, we are still paying on the mortage. Is the building legally still ours or the church?

Hi Viola,

Welcome to the forum.

The building does not belong to you now. As soon as you have quit claimed it to the Church, the Church authority becomes the owner of the building. But the mortgage has not been taken to the Church authority name. So the mortgage still remains in your name and you will have to pay the mortgage

My parents passed away several years ago and at the time of their death owned one cemetery lot with 4 grave plots. They purchased the lot thinking that my wife and I would use the other two someday. The lot is still in their name.(Joint tenancy) I had a brother that died several years ago and he had two children. Would it be correct to have them sign a quit claim deed over to me and my wife even though their names are not on the current deed?

Hi Rlc,

Welcome to our community forums.

There's no need to have the children sign on a deed when their names are not on the title. If the lot is still in your parents' name, then using the right of survivorship in joint tenancy, you can automatically inherit the property.

How does a quit claim work if I still have a mortgage on the house, but the person I am quit claiming it to wants to sell the house?

I am divorced my ex signed a quit claim during the divorce both of our names is on the property I want to know if he can reclaim this house or if he has any rights to the house I am concerned because he has remarried an all of a sudden his new wife mail is coming to my house. she is into realestate they live in another state.

Hi Rory,

Welcome to the forum.

Rory, have you informed the lender before signing the quitclaim deed? After the quitclaim you do not have any rights on that property but if the grantor to whom you have quitclaimed the property did not refinance the loan on his name then you are still responsible for the mortgage and the lender has all the rights to claim the money from you.

So I think you should request him to refinance the loan on his name as you have quitclaimed the property to him.

If your ex- husband has quitclaimed the property and you have notarized and recorded the deed in the county recorder office then you are the owner of the property now and he cannot reclaim the property from you.
