Can quick claim transfer personal property?

My boyfriend and I own a home, and now are splitting up. Is a quit claim deed sufficient, or will I need to get a new loan??? If he is off the deed, will the bank make me refinance?

Hi Kimberly,

A quit claim can be used to take your boyfriend's name off the deed. But it is better to use a warranty deed which actually guarantees that the title transferred is free of any lien.

I don't think you need to get a new loan for that. If your boyfriend is off the deed, the bank will allow you to refinance depending on your credit worthiness and current financial situation.

Before you sign any deed and apply for a new loan, know more about quit claim, and refinance.

We purchased a lot about 13 years ago on a quick claim deed. Built a house soon afterwards. Is there a problem with only having a quick claim deed?

My sister was about to go into forclosure. Her financial adivsor suggested that she quick deed the house to me and this will stop the foreclosure. We did the quick deed and now they are working out a payment paln. THe emortgage company does not know that we did a quick deed. If the company decieds to forclosed what does that mean for me? Will it actually stop the forclosure on my sister's house. I paid her nothing for the quickdeed.

Ladyg,

You should let the company know that your sister has transferred her property interest through the deed. Because the property is still mortgaged with them.

I don't think that quit claim can stop foreclosure.

Hi,

It’s good that the company is working out a payment plan for your sister. But if does not work out as predicted, the company may demand the money from you since the ownership interest is now transferred to you through the deed.

Can I do a Quick claim deed, to transfer my home to my daughter ? If not how can I do this without it costing a lot ?

Hi J.T,

You can surely use a quit claim deed to transfer your home to your daughter.

I do not see any reason why you can not do so.

As per my knowledge it is one of the simplest methods for such a transfer.

It will help you understand the procedure by which you can quit claim your home to your daughter and also the requirements for such a transfer.

I'm a home owner whose having a lot of financial problems since a bad car accident and hurricne damage 2 years ago. A family member is wanting to assist with us transferring ownership of our property to them. I would remain in this home paying the mortgage once it is refinanced by the family member. How quick can this be done? the refinancing? the whole transaction?

It feels good to hear that your family member is trying to help you when you need it the most. Regarding the refinance, the time taken will depend on how fast the family member is approved for a loan from a suitable lender.

The time will depend on how quickly the ownership of the property is transferred from you to your family member. This will also depend on the legal process carried out by the attorney for transfer of ownership in the property.

I am part owner of a timeshare and I want to quitdeed it to the other person, will this clear me from all future payments for this timeshare if the person does not make any payments or is it better to do a waranty deed
