I took a mortgage loan and moved into my new home this august. My contract said that all the assets of the previous owner will be removed. But this was not the case when I first walked into the house, they left a lot of there stuff. Also some repairs were supposed to be done which wasn?t done. Can I do anything about it or it is too late to take any action?

Hi Neal,

Welcome to MortgageFit Forums.

It is very difficult to come out of such situation specially when the deal has been closed in august. At the walk-through prior to closing you could have checked to determine whether or not the requirement of the sale contract has been met. If not you could have insisted to keep aside funds for cleaning the property and make repairs.

But with the settlement past it will be difficult if not impossible to get compensation. But you should still look to talk to your lender and see if he can help you out.

Hi,

I think you are right samantha i should have reported all these prior to the closing. and now its too late for asking for any compensation. any way i will talk to the lender as advised by you.

We own a home and falling behind on my mortgage payments after we refinance and didn't realize that we were in an adjustable rate, also due to my husband being furlough and getting a job that wasn't paying as much. We pay my propery taxes separate and home insurance separate from our mortgate. We recently received a letter from our mortgage company that we are in breach of contract. What does "Breach of Contract" mean for us?

You've mentioned that you've fallen behind on your mortgage payments. This can be considered as a breach of contract. You are liable to pay your dues on time every month. As you're falling behind, you are actually violating the terms and conditions of your mortgage payments. Nevertheless, I would suggest you to have a word with your lender and clarify the whole issue.
