Can I protect myself against any probable mortgage discrimination?

Hi,

Yes, you definitely can get protection against any mortgage discrimination. In fact HUD provides assistance to people to find government organizations handling complaints against housing discrimination.

The Equal Credit Opportunity Act (ECOA) and the Fair Housing Act (FHA) is meant to provide with protection against any discrimination faced while applying for a mortgage to purchase, refinance or make improvements in home.

ECOA doesn't allow discrimination based on -

  • race or color
  • religion
  • national origin
  • sex
  • marital status
  • Age (provided the applicant is having the ability to contract)
  • A person's income receipt derived from any public assistance program

Likewise FHA also disallows discrimination based on -

  • race or color
  • origin
  • sex
  • religion
  • family status
  • handicapped ness

Hi,

I was not aware that complaints can be lodged against any discrimination. I had a similar incident six months back. Can I file a case now?

Hi Goff,

It is really sad to know of such incident that you faced. You can certainly file a complaint with HUD or file your own lawsuit in federal or state court.

You have one year from the date of the incident within which you can file a complaint with HUD. If you choose to file your own lawsuit in federal or state court, then you have to do so with two years from the date of the incident.

So, both the options are there for you since you faced it only six months back.
