WHY DOES FLORIDA REQUIRE SEPARATED (MARRIED) SPOUSE TO SIGN MORTGAGE DOCS WHEN HE/SHE LIVE IN A DIFFERENT STATE AND HAVE BEEN APART MORE YEARS AND THEY ARE NOT ANYWHERE ON THE SUBJECT PROPERTY IN FLORDIA.

Hi Jim,

Welcome to MortgageFit Forums.

The reason behind that is Florida treats a person as either married or single. The law existing here does not recognize separation.

So, if you want to write her name off you must get divorced or you need to convince your spouse to join in executing the mortgage.

Hi Jim,

I want to add a little bit. If you consider for divorce then all the debts should also get resolved at the time of divorce.

You should settle the matter regarding who should pay the mortgage to avoid any future problems.
