My dad and I are on title. Recently, my dad quit claimed 50% of his property to me. Now, I have 100% ownership. A couple of months ago I received a Grant deed stating that my dad and his wife are on title. Is this legal?

Welcome to the Mortgage Fit Boards.
Putting my two cents in, I would say that if the property was transferred to you (100%) then he should not have been able to add himself and his wife.
However, the best advice I would give you is to consult with an attorney on legalities. The reason why I suggest that is we give advice out freely and are looking out to help you the best we can.

I quite agree with what cliff has suggested once your dad has quit claimed his property to you than he cannot add your mother or himself. And as mentioned by cliff for further suggestion you should consult your attorney he may help you in better way.

Hi Erica,

I don't think it is legal. This is because the the title to the property included you and your father, and not his wife. In a quit claim deed, only the interest is transferred from a grantor to the grantee. This implies that through the deed your dad has been able to transfer only his interest in the property to you. The title to the property remains unaffected in a quit claim deed. The title to your property still includes you and your father. Therefore I think it is illegal to include his wife within the title.

I would suggest that you consult an attorney for any further course of action.
