Now the mortgage company has to foreclose legally if it wants to to foreclose before I move out. My attorney told me that I can stay in the house till the mortgage company succesfully forecloses on my property.

According to the bankruptcy code, you must tender the surrendered property to the creditor within 45 days after you filed bankruptcy. In some states though, the bank allows a person to stay in the surrendered property until the Sheriff sale. Consult your bankruptcy attorney for the allowable limit in your state. God bless you.
