I HAD TO LEAVE MY HOME BECAUSE I COULD NOT AFFORD TO MAKE THE PAYMENTS ANYMORE WITH MY NEW PART TIME JOB. I CAN NOT KEEP BORROWING MONEY FROM FAMILY AND MY HUSBAND IS NOT ABLE TO HELP ANYMORE. WE HAVE TEMPORARILY SEPARATED. SUNTRUST BANK IS SUING ME NOW. CAN THEY TAKE MY SALARY AWAY FROM ME RIGHT AWAY FROM MY CHECKING ACCOUNT? OF IF I HAVE ANY SMALL SAVINGS CAN THEY TAKE THAT NOW?

Hi MADELEINE,

If the Suntrust Bank gets a judgment against you, then they can garnish your wages or place a lien on your car or garnish your savings account.

Thanks

Hi kathy!

Welcome to forums!

Like any other negative item, the repossession will remain in your credit report for the next 7 years. However, with time, the negative effects of repossession will lower. So, your credit will start improving and you will be able to get a refinance for your existing home.

Feel free to ask if you've further queries.

Our mobile home is located on my Mother's property in Texas. If the mobile home is reposessed, could the land become involved in any way? The mobile home and septic tank are the only items on the loan. The land has been paid for a long time ago.

Thanks,
John

Welcome alisha,

The lender will provide you with an eviction notice mentioning the time period to leave the property. You will have to leave the property within that time period. You may be able to charge a storage fee to the bank.

Hi JohnK,

I don't think the land will become involved in any way though the property is foreclosed.

We fell behind on our payment and can't get the money to bring it current. The mortgage company says they will "send it to the legal department Monday" There is no land attached to the loan. What type of time we will have to move once that happens? Thanks for your help

Hi Soufanieh!

Welcome to forums!

Once the repossession is complete, you will receive an eviction notice from the lender. This notice will mention the time period within which you will have to leave the property.

Feel free to ask if you've further queries.

My husband lost his job in 2010 and hasn't been employed since. We were keeping up on our home payments until around four months ago. Now they are saying they will foreclose on us. How long do we have to find another place? Also, I read there are two types of contracts or deeds. One is where the lender has to take the buyer to court and the other one is where the lender doesn't have to.

Do you know anything about these different contracts?

By the way, the lenders wanted $1540 by March 1, which we could not come up with. So we already had a payment situation lined up. They refuse to work with us anymore. Mainly, I want to know how long we have to find other living arrangements. I'm a retired senior on a fixed income of, get this, $178 a month. Hubby is almost out of unemployment.

Hi Clairetta!

Welcome to forums!

You will be able to stay in the property until the foreclosure sale is complete. After the foreclosure sale, you will receive an eviction notice from the lender which will mention the time period within which you will have to leave the property.

I guess you're speaking about judicial and non-judicial foreclosure.

Feel free to ask if you've further queries.
