notice from the creditor after bk discharge

I had filed a no asset chapter 7 last year and got discharged this year in the month of January. Recently I got bills from one of my creditor who was not included in my list of creditors by mistake. I replied him mentioning about the BK. I also sent the certified letters and gave him the case no. and date. He replied me back asking to show something where he has got listed among the list. He says that he was never notified of the bankruptcy. Do I need to pay him? Actually I called the BK court but they refused to reopen the case for this.

Consult with your lawyer in this case. That debt will be discharged as well. You need not pay him.

Yeah, no need to pay him once you got discharged with a no asset case. It doesn't matter whether he was included or not in this case.

Hi,

It's understandable why the court refused to reopen the case. In a no asset chapter 7, the creditors are not going to get any distribution from the estate.

So, no purpose will be served by reopening the case and adding a missed out creditor to the list. Any left out debt is also discharged due to the fact that there were no assets available to distribute.

You need not get worried because of not listing him. You need not pay him further after getting discharged with a no asset case.
