Hello,
I have a question on the payment issue. My mortgage statement says that my first payment is due July 1st. On around July 2nd I called to ask where to send the payment since the documents had two different address's. They stated to me that my first payment was not due until August 1st. They then sent me a letter welcoming me and also stating that my first payment is due August 1st. In August, Sept., and Oct. I made my payments on time no issue. Then I just recently got a statement stating that they reversed my payments to cover July's payment and that I then still owed them for Oct. However, my statements in Aug., Sept., and Oct stated that I was current, then this new statement 10 days after my Oct. statement says that I am late for October. Now they want both payments even though I was following what they stated to me both over the phone and in writing. PLEASE HELP!!! Can they do this? |

Hi smith.annemarie,
Welcome to MortgageFit Forums.
It's quite disheartening to find the behavior you are facing from your mortgage company. But you are in a strong position, so you need not worry much. Just stay cool and you will definitely come out of this problem.
I think you have got the payment receipts with you. Along with that you have the statements declaring your first payment starting from 1st. Aug. and all other indicating your due dates.
So, with all these papers, you are on the stronger side and the mortgage companies can in no way charge you for their own mistake.
I shall suggest you to consult your attorney along with all the papers and your attorney will definitely find the best way out for you and you will certainly come out of this problem.

| Thank you for the response. I have my bank statements that show when the payments cleared my bank. I am just nervous becuase they are saying that even though the letter that I have states the first payment is due August 1st, they are saying that the closing statement shows July 1st. I understand that the loan documentation states July 1st. That is why I called to make the payment. But when they told me twice over the phone and once in writing, what else was I supposed to think. I am not a mortgage attorney. I just do not know how much legal standing my document has in a court. I would think that something from the mortgage company stating when my first payment is due would be enough but the mortgage company just states that the letter was sent out with incorrect information and therefore I have to pay the double payment. Hi,
It is a problem faced by a lot of borrowers today. The mortgage companies and lenders are taking advantage of the ignorance of common people and charging them for their own mistakes.
It is natural to be nervous on your part, but at least I feel you are lucky and intelligent enough to keep all the documents with you.
I am sure, that you will overcome this problem. Consult your attorney and he will guide with the best suggestions.

| Thank you very much for your kind words of wisdom. It is nice to read this instead of the verbal abuse and rude attitude of the collectors from the mortgage company treating me like a cheat. I will certainly work with an attorney to get this straightened out. P.S. Please excuse any spelling mistakes, I type quickly when I am frustrated. Thanks again!!!!!!!!!! |
