I got a payday loan a year and a half ago approx. I thought it was paid until just recently when a Mr. Brown called me and threatned me with legal action. He told me I owed thousands of dollars, but if I made arrangements to pay he would settle for the original $300 plus $90 finance chg. Scared I agreed, and have paid $100, but I have no proof that I even owe this and don't want any problems, but am out of work and don't know how I am going to pay this or if I even owe it. Reading all the other post from everyone I think these people are nothing but scam artist praying on vulnerable people.

Debbie,

You should send a debt validation letter requesting proof the debt is actually yours. If they are not able to validate it then you cannot be forced to pay anything.

I got a phone call at work regarding a $300 loan I received from G. Roth and the person I spoke to Mr. Brown was extremely rude, told me I was just like everybody else who didn'e pay their bills. I asked him his first name he told me I wasn't one ofhis friends and he didn't have to tell me his first name. By the time I got off the phone with this guy I had an extremely terrible headache. Where did he get off talking to anyone like that. I was very upset, I had every intention of paying this money back but I can't right now and all he wanted to hear was when. I eventually jsut hung up on him.I will not be talked to like that by anyone.

Hi Simmons,

Let me tell you about one FDCPA law which can be used to stop such calls at work place.

As per FDCPA, if your employer has objections to collection calls at workplace then you or your employer can inform the collection agency about the "no call policy". Collection agency can be informed in writing or verbally as verbal notification is supported by FDCPA. After they are informed if they again call you at office then they would be violating FDCPA and a lawsuit can be against them for the violation.

Hello Simmons,

Well, according to the FDCPA act, the collection agency cannot not call you or harass you during your work period, if you have already specified that they should not do so.
If this continues, then you are eligible to file a case against the company in the Federal court for violating the terms and conditions.

Many people have fallen prey to this nasty company, including me. I am in the process of getting a refund from my bank.

1-If you have or had Geneva auto- drafting from your bank account -- SHUT THE ACCOUNT DOWN IMMEDIATELY!! and open a new account.

2-You will then need to write a memo stating why you want a refund. In my case, even though my small loan was paid, including fee, they continued to draft, hoping I wouldn't notice. They named their company almost identical to a legitimate investment company to confuse you and hope that you will over look the draft in the event that you have a legitimate Roth account.

3-Your bank will then give you instructions on where to fax your memo for the refund. Memo must include signature along with full account number, state where you opened account, $ amount of each transaction, your phone # and fax if you have one. Most likely you will send the fax to ACH Services, Corporate Returns.

The downside is...if you do any online banking...that feature will be temporarily shut down for your protection until the matter is resolved.
Pain in the butt, on the other hand, worth the trouble of handwriting checks long enough to stop the madness.

I am so glad that you gave the information. I was thinking of contacting the company for a loan. But after seeing the information provided by you, I am not going to contact them now. Smile

They have debited my acct twice in last 3 weeks & I have no idea who they are. They took $90.00 each time. I went to the bank today to file fraud charges against whoever they are.

Hi Imnbama,

Welcome to the forums.

You should immediately contact the bank officials and explain that your account is being debited by someone unknown. They will guide you on what necessary action can be taken.

As far as geneva Roth is concerned, if you haven't taken out any credit from them, they shouldn't be taking out money from your account. But I think you should first get con firmed as to which company is doing it and then take necessary legal action against them.

Does anyone know of a form letter that I can send to this company as well as Broadmore Ventures. they continue to take money out of my account and when my bank disputed Geneva it came back as Broadmore. Anyone have any ideas? I've lost over $300 b/c of this mess.

La,

You need to contact your creditor and explain them the problem you're going through.

The creditor can ask for some proof as to how you could find out that the company been taking out money from your account. While you are writing the letter to your creditor, you may refer to a sample letter that will help you in dealing with the creditor.
