What are the legal actions taken if I refuse to pay back 840 dollars on a 300 dollar loan. That is rediculous!!!

Hello Tiffany,

If you can prove with all documents that Geneva Roth is doing fraud, then it is you who can take legal action. But everything should be done legally with the help of an attorney.

They're are the ones who got me the loan through Geneva. I found this on their website.

The loan agreement is governed by the State of Utah.

Utah residents may contact the Utah State Department of Financial Institutions at 801-538-8830.

Residents of other states may contact the regulatory agencies of the states in which they reside.

We can not set anything in wrinting, if you have concerns about your
payment history, you must refer back to your bank statement

Geneva Roth is now Loan Point....Wow what crooks...I had a loan with then and I have to go through red tape to pay it off...I paid almost 4x the original loan amount....your better off robbing a gas station,or selling a body part...Good Luck

Hi,

Geneva Roth doesn't work as Loan Point only. I suppose they have many other names and keep carrying their fraud business.

question can u close ur acct before they debit u will they bank still let them debit my loan ok the loan was took out on the oct 26/ 2007 due back on the nov 9th 200 for 260 and if i knew what i know i wouldn t have done it can i close my acct now and just mail the payment in in 2 weeks so they wont rob my a cct

Hi Guest,

It seems that you are upset, please don't. Things will be ok with time. What I feel is, if the creditor is used to withdrawing cash from your account for the purpose of getting the payment, then he needs to be informed that you are closing the bank account. And, then you can close the account thereby sending the payment by mail.

I've had $30 taken out of my acct 2x per month on
a $100 loan. This is insane. for the last 6 mos they've
taken 60.00 from me for a $100 loan, and you have to
send the paperwork back 5 days before due day or they
can't take the full payment? These people need to be in
prison. thats 60% interest?? Theives.

I spoke w/ my bank, I was informed you can write a letter
to this company and tell them you are no longer allowing
them to remove payments from your acct. Send it certified
mail, and get a receipt, and copy of hte letter. If they do
continue to take it out, the bank will recredit your acct and
then fight it out with them. That does not mean you don't
owe the loan...but as far as I'm concerned I feel as I paid
this loan 8 or 9 times now., and these crooked theives are
not getting another red cent from me.

I was also informed even if you close your acct, if an authorized
electronic debit comes out, it reopens that acct, and your responsible
to pay that payment. Please check with your banking institution before
you do any closes.

Hello Arlene,

I can understand your situation. This has been a long time story with Geneva Roth.

Did the bank tell you so that your account could be re-opened if there's an authorized electronic debit? If you take out all your money from this account, is that still possible?

Have you spoken to your bank about putting an overdraft protection to your account? I think this could be of some help.

You should take legal steps against this company and report to the BBB about the fraud.

Yes they informed me that if you have closed your account, even if there is a 0.00 balance in that account, if there is an auto electronic withdraw, you will still be responsible for it. You MUST write a letter to inform the company you are no longer authorizing electronic w/d's from that acct. Whether its an open or closed acct. You still have to write. Best thing
is to send the letter certified mail so you have proof they did receive it.
This way if they take anymore payments after that time, you are not
going to be held liable. If it is a legal debt, you still have to make arr. to
pay it,. But they can not take it at will.

I too have had problems tracking this company down. The thing is I never applied for a loan with them. Money just showed up in my account one day and I called the bank to check it out. They gave me the name of the depositor and I have been trying to track them down. Until now I have not been able to find anyone that had ever heard of them. Of course they are taking funds out of my account now and the money has been way over-paid but they continue. After putting a stop payment on them the change the amount by 1 cent and continue debiting my account. I STILL have never spoken with ANYONE from this "ghost" company. What can I do?

Hi carolyn,

Welcome to this forum.

Sorry for the delay. People call Geneva Roth a Loan Shark Company. Many of our forum members had bad experience with them. The complaints against them are increasing day by day. What they are doing is totally illegal and it should be stopped. You can file a complaint against them with FTC, State Attorney General Office.
