Hi,
As far as I know SJM marketing is affiliated to Elis Corby which is a debt collection agency and doing some legal activities. In this thread, you have seen that this company has already done frauds with our different members.
You can collect the contact from this thread ( http://www.mortgagefit.com/discuss/sjm-marketing.html )and try to contact them. At last if you did not found any result, you can file a complaint against them.
Thanks |

Hi Tracey,
You need to have the contract in writing. Ask for your copy from SJM.
Make the company aware of your state laws. SJM Marketing is not outside the law. They have to lend money to borrowers in your state after having a valid license. Check the company license with your state Department of Financial Institutions (DFI).
With that said, make yourself informed about the payday loan laws and go through your payments done towards this account. If you have paid the full amount, force them to mark your account closed in writing.
Perhaps, SJM is charging you the finance fee of $90. Are they rolling your account? You need to check with your state laws on whether roll overs are permissible or not. |

If anyone can assist me with the problems of dealing with this company, I would be greatly appreciated. This place deducted $75 per payperiod from my account starting in August of 2006 and I thought it was paid in full through November. I since then closed my bank account which was in December and I just received a call from Bass and Associates, stating that this company or PRemier Processing to be more specific, is filing somethign against me which includes Larceny. I find that beyond disturbing as first of all no one bothered to call me to state that I owe this money and it has been what 30 days since their last deduction from my account? I did even inform this firm that I would be more than willing to pay the $290. 00 they claim that I owe but in no way am I going to pay $678.50! They refused. I contacted an attorney, but I have not heard back yet...If anyone can offer any advise I would appreciate it. I am not a criminal - I don't have a record - and I have never been in trouble with the law and this is absurd!! _________________ Need help choosing the right loan? Post subject: RE: complaints against premier processing or SJM marketing |

Hi Tguest,
Welcome to our forums.
Premier processing or Ellis Crosby or SJM Marketing all seem to be a single company working under different names. There are several complaints against this company from this community and others as well.
But this is really rude on their part to indulge people in larceny and other criminal activities. And, I feel you should not even pay the $290 leave aside the $678.
The company you mention has been threatening people and getting extra payments from them since a long time, but unfortunately nothing can be done against them. The most important thing is that SJM Marketing probably does not have any physical existence and hence it is difficult to catch them doing illegal things.
I think you should wait for what the attorney has to say and then proceed. And let our community know how the attorney has advised you to deal with this kind of company if it goes on affecting people in this way.
Hope things will turn out well.
Thanks,

| I took out a $200 and have been making payments of $60 a paycheck for about the last year, now I had to close my account and open a new one but I can't seem to get a hold of them. So I got a call from Bass and associates and a lady named Kimberly Davison said she is filing a suet with the state and county tomorrow if I don't money gram them $541.50 by 1pm tomorrow. Now I have made plenty of payments for that place to make money should I be worried about this right now or should I let it play out. I asked her if they were going to arrest me or what and she said she wasn't sure of the laws in New Mexico but it is not a misdemeanor it is an out of court restitution. So is there anything they can do to me at this point or is it a bogus threat, she said she would like to talk to my retention attorney. Any in-put would be greatly appreciated. Thank you. |

Hi Rustin,
Welcome to the forum.
It seems this is just a threat so that you give them more money. Usually collection agencies call up debtors for payments when the creditors sell the loan to those agencies. But in your case, since you have been making payments, therefore I don't think it will be any such agency. The company is just sending you threats to extract more cash.
If they wish to talk to your attorney, let them do so. At least you will come to know what they talk about and what they intend to do. Then you can file a complaint with the FTC, state attorney general or the Better Business Bureau and wait for their reply. Or else, you may consult your attorney and proceed as he says.
Hope you get through this problem soon.
God bless you.

So i just received another phone call from Bass and Associates saying that I failed to follow up on the arraingements to send them money and lady tells me so do you not intend to pay this and I said not right now and she said that they are going to let the authorities know where I work so they can proceed accordingly and I told her ok. And all she could respond with was in a bad attitude with "OK Good Luck" and then hung up on me. So what do you think of this action sounds to me like another threat, there is a lot of commotion in the back ground when they call like they are all in a call center just trying to get more money out of us. So sounds interesting and it to me I don't think there is really much they can do at this point I think she hung up on me because I told her no and so she got mad because they are not getting more money out of me. Thank you for any input you may have.
Thanks again

Did you notice? They are begging you for money and posing lame threats. Don't be afraid of them because if they really had anything to do, they would have done it just in time and won't have called you again and again.
Just be aware of your legal rights and keep all documentation complete. Send a Debt Validation letter through certified mail and return receipt requested. This will ensure that you have taken legal steps to get the information about the debt and the ball is in their court. The responsibility to provide the details of the debt rests on them. If they do not respond then, the debt they are say you owe them is not correct and can not take any legal action against you.

Well Rustin, I agree with you, that's another threat. Do they know where you work and even if they know, if you made all payments, why do you worry? You can at least prove your employer that you have been up to date on all payments. I hope you have all the proofs of payments, receipts or whatever they have given you.
Now, if you get any other threat from them, talk to an attorney and take legal advice as to how you can stop them. Otherwise, they may continue with their threats till you get disturbed and pay them the money.
Thanks,
Caron. _________________ Mortgage Shopping made easy with booklet |

| OK just got a call yesterday from a company United Processing Divison. They are the RUDEST most TREATENING company. First of all you can't understand a word they are saying. I asked for someone else that spoke clearer english and all they did was repeat themselves only louder. I asked for SJM's phone number to confirm this wasn't a scam and they said that SJM wouldn't talk to me. That was a BIG LIE!!. Then when I called them back they would not accept the payment I was offering. They said I was trying to get out of paying off my debt. So I guess offering some money is trying to get out of paying off my debt. When I asked for a supervisor and they wouldn't give one to me and when they finally did all he said was "good luck to you" and HUNG UP ON ME!! Now they want me to call them every two days to update my case file. WHAT IS GOING ON??? Can anyone help? |

| I would say, you file a complaint with the state attorney general's office for the bad behavior you had received from them. |

Welcome Miamorski,
Is it that SJM is somewhat connected to United Processing Division? This company it seems is in contact with several other companies doing frauds. And, so may people are complaining in this forum. It seems surprising that no legal authority has taken any action yet. _________________ Procrastination is the enemy of your financial sucess |

Hi Miamorski,
I searched for this company details at the website of the Florida Department of Financial Services. But unfortunately could not find it. You can just try out by yourself once. May be I have missed out any name from the list shown.
Refer to http://www.flofr.com/Finance/licensecheck-dof.htm and choose the option that will help you get the required information.
However, if you cannot trace the company from this website, I think you should use the consumer helpline provided at http://www.fldfs.com/ .
Thanks. |
