| in October 2006 i applied for a cash payday loan online, but I talked with the company, and they turned me down. then i got an e-mail with no way to contact them from another cash payday loan company that confirmed that this company put $200 in my account. i did not have an agreement with this company, and no way to contact them. after a few weeks, they took $75 out of my account in "interest" then the next payday they took $125, and they continuously keep trying to take out $150 in three separate installments, each payday. i intentionally let the charges bounce, because i thought they would call me to pay the loan off, but no one did, and my savings account has a huge negative balance, and the bank says that if they close in the ACH debit will just re-open it. My bank googled the company for me to help me resolve this, and that is how I came across your question. So the answer is that you have on purpose or accidentally taken out a payday loan through Premier/ SJM. if you find out more, please post anything helpful. i am going to call a number off of one site, but now i am scared of speaking to these people after reading all of the online warnings/ stories. |

Hi,
I have also read many of the other posts about the illegal ways they take out money from accounts. You should file a complaint with your state attorney general's office about it as early as possible.

| I am in the same boat as most. I took out a payday loan with these people about 5 months ago. By my rough calculations I have paid back over $900.00 on a $300.00 loan. Any ideas on how much they will continue to take? Did I sign a loan agreement for life? |

It's not that you have signed on the loan agreement for your entire life. But these payday loan lenders charge excessive fees on the amount they offer as loan. And, if one is unable to pay it off within the specific time period, then he has to renew the loan. For the renewal, the payday lenders again charge high costs and then you need to pay the fees on the amoutn borrowed.
Most borrowers going for payday loans fall into the trap of high fees and costs and yours is no different.
I think you should sit down and make a budget. Try to restrict expenses in other areas and pay off the loan as early as possible. Otherwise, it's going to take out a thousands of dollars from your pocket.

| Hi, I have been trying to contact SJMmarketing for about three almost four months. I took out a $200 dollar loan and have been trying to pay them back but, i can't reach them by Phone, fax or email. this company is takeing $75.00 out of my account every two weeks for a finance charge. I really want to pay them back, but i feel i have paid more then my share. I have been trying to contact them and no one has contact me. I called my bank to put a stop to the automatic payment, but they say that it may not stop this company from getting the payment, then i asked about closing out my account and they said that SJM Marketing could reopen my account and continue to take out the finance charge. I can't beleve that they could have this much power to enter into someone personel account. I really want this to stop does any one know what i should do Help Please. |

Welcome to our community forums.
I am surprised to hear that the bank has refused to stop the company from taking out money from your account. Do you have any documents which can prove that you have been dealing with SJM marketing? You need to show them to the bank. How can the bank officials disagree to stop the company which is illegally taking out your money? It is the bank's responsibility to take care of such things happening to its customers. And, I agree with you, no company can have that power to withdraw money from someone's personal account in the manner SJM has been doing.
I shall suggest that you file a complaint with the FTC regarding this company but then it takes time to take action against such illegal practices. In the meanwhile you may contact an attorney who deals with frauds and scams and take legal advice from him.

The federal trade commission or the FTC can help to get your money back or they can take legal action against the company. |

Welcome Kay,
I can understand what you're going through. But hey, are you able to contact them? You know what, these guys keep on changing their contact numbers and that's the reason why it becomes impossible to trace them. Even in this community, I have come across several people complaining to the FTC about this company but I guess it's very difficult to catch hold of them and punish them for their illegal activities.

| I've spoken to my lawyer tonight after a threatening phone call from sjm or whom ever their collection agent is. First off they are violating the Fair Debt Collection practices by making threats against you, Secon by requiring you to send them any money without paperwork as to collecting the debt, what it's cost is, financing fee or any type of criminal charge they wish to file against you. I had a heart attack two years ago but had managed to pay down my debt except for the "origional " loan. Since Delaware cracked down on the PDL's I have more than satisifed my debt. Fortunatly the FTC and your State Attorney General will help. The threats they make are illegal and they should be informing you they are attempting to collect a debt ( debtor's prison went out in the 1800's) with the first phone call. Locating these loan sharks is impossible since they are a mobile business. Federal wire fraud consist of a transfer of funds to a bank account that you close the day you withdraw the money, not when you continue to let them withdraw ACH. These people are predators and rely on the fact that at the time you took the loan you were down and needed the money, but after two, in my case three years, situtations change. They say you cannot file or be a party to a class action law suite against them, but you are entitled to individual suites, filed either through a private attorney, or the FTC, for compensation for the harassing tactics and illegal collection methods that they use. And this includes the origional company, not just the collection agancy |

It's really bad of the SJM marketing. They should not have given you threatening calls. Moreover, without involving any paperwork, you must not give them money. And you need not fear their illegal threats.
I know that it's very hard to locate them as they continuously change their address. At least, it's good that the FTC or the state attorney general is by your side. They will help you to deal with this problem. |

I have had similar contact with these people. A Ms Perez calls me at work and tells me I now owe an excess of $600.00.
She said that they are going to charge me with going over state lines with cash. She also told me to deposit funds into a Bank of America account if I wanted to pay this off.
I have seen an attorney and he'd like the address to SJM Marketing and also my account number so we can sort this all out. Can anyone help me?
