My partner and I bought home in FL. I am NOT on the mortgage note but AM on the Title. My partner is filing Bankruptcy Chpt 7 and is including the home. [due to extensive loss of income] Bank is not lowering loan modification pmts to anything affordable. And we heard that if we short sale...the bank can file a defiency judgement on her within 5 years after sale. So her only option, we feel, is to file BK on her $60K+ debt and the house. Since the house is NOT in foreclosure [yet], how does this work? And will the bank try to come after ME if I am NOT on the mortgage note?
