My parents live in florida and was wondering what happens to the property when just the husband's name is on the deed and he passes away. What is the wife's entitilement? They've been married for over 40 years. Not sure if that effects anything.

Hi rrpalmieri,

If it's a comunity property state, the wife should be entitled to a certain portion of the property as per the Moore Marsden Rule. If they are listed as joint owners with right of survivorship, the wife will inherit the husband's portion after his death.
