I have an odd situation, and need some advise.

My father and sister signed for a mortgage for my mother and fathers house.

My sister has filed bankruptcy (#7) and is no longer liable for the mortgage, as she included it.

My mother and father are both on SSI and are facing serious repair issues with the house (roof, electrical, plumbing..etc) and can not afford the reapirs nor the adjustable mortgage rate payment, and are going into foreclosure. Again, at this point it is now only in my fathers name.

My question is this: Can my mother or fathers SSI be pursued for the deficiency balance after the house sells? The property is located in FL.

Hi Guest,

Social security income cannot be garnished by the lender. If your parents have a savings account, then the lender can get a judgment from the court and garnish that savings account.

If my mom has a savings account, but she is not listed on the mortgage, title or deed...can she be pursured for my fathers foreclosure?

Hi Guest!

Welcome to forums!

If your mother's name is not mentioned on your father's property, then she won't be held liable for the foreclosure. The lender will not be able to come after your mother's savings account to recover the dues.
