I bought a condo in Florida 3 years prior to getting married. Hubby has never contributed to anything having to do with the condo and I never added him to the deed. Will this property have to be divided with him upon divorce? Thank you

Hello Ivy,

I think you may have posted this twice since I saw another post very similar, but I will go ahead and give you the same answer here as well.

Since laws regarding equitable division of assets vary from state to state, I would advise talking to your attorney about it. If he was not added via quit claim deed, then it is also assumed that he is not included on the loan as well. If this is the case, you may be in the clear.

If by chance, your attorney advises you to go ahead and get an appraisal on the property, be sure to select an appraiser that specializes in litigation support and expert witness testimony. It may cost more than the typical appraisal but will be well worth it to have someone with courtroom experience.

Welcome IVY.

You have bought the property before your marriage and you have never added your husband on the deed. So he should not get the property or the property should not be divided. But in divorce things may get ugly. So take guidance from an attorney on this issue.

I signed a quit claim deed, but the house is also up for sale until it sells. Am I entitled to see the offers on the house?

Hi teach,

When you sign a quitclaim, you give up your share in the property to another individual i.e. the grantee. As you have already quitclaimed the property, you do not have any legal claim to the property and thus are not entitled to see the offers on the house.
