Can I file a Quitclaim Deed for a Property in West Virginia while living in Florida?...My mother-in-law just recently was told by Social Security that she cannot have her property in West Virginia and continue to collect. How can we transfer this property to restore her ssi.

Welcome to forums!

You cannot file a quitclaim deed and transfer the property of West Virginia while living in Florida. The quitclaim deed forms for both the states may be different. Moreover, you'll have to record the deed at the county recorder's office where the property is located.

Can a deed and title on a property in WV be transfered to another person while there is a mortgage on the property?

the physical location of a person has nothing to do with whether a deed can be completed and recorded appropriately. as long as the proper state-specific document is completed correctly and filed correctly, a person in florida can do a transaction on a property in west virginia...vice versa as well.

yes. you can easily do it. but it need to be registered in local clerk's office
