In Florida, how long do I have after the foreclosure hearing (where the foreclosure judgment will be made) to vacate my house? The estimated foreclosure sale date is not for 6 - 8 weeks after the hearing. Thanks!

Welcome to forums!

As far as I know, in Florida, the foreclosure time can range anywhere from 6 months to a year. I think you can stay at the house until you receive an eviction notice. You will receive this notice when the sale of the property is complete. In the eviction notice you will be given 3 days time to leave the property. You can call the bank's attorneys and work out an agreement which will let you rent the house for a low amount until they find a buyer.

So I do not have to vacate the house before the foreclosure hearing?

I have been told by friends (who heard it from a friend, etc, etc) that I should clear everything out of the house by the date of the hearing. That has been my confusion - at what point does ownership legally pass to the bank? When is my last chance to move my stuff out?

Hi nsavory!

I think you will have to start moving out your personal property from the house as soon as you get eviction notice. As far as I know, the ownership of the property passes away to the bank as soon as you receive the foreclosure notice. It will be better if you can talk to the lender's attorney in this regard.
