I recently found out that my father passed away in 2004 in Florida and I live in Ky. I was his only biological child. I only found out by a fluk that he had a will. I was never informed of anything and my dads side of the family cannot stand me and I'm sure would try to keep me from inheriting even a penny. Is this right and can't I do anything about it? I read somewhere that even if you aren't named in a will that a sibling is entitled to something. This is very disturbing to me since I never got to see my dad before he passed away and wasn't ever told anything about him being ill. He lived in Florida and I live in Ky. and hadn't spoke to my dad in years.
Its not even about money to me, its about my so called Uncle keeping things from me that should be mine.

It really makes sad reading that you never got to see your dad before his death.

You are saying that you by some chance came to know that your dad did make a will. His property will then be divided as per instruction given in the will. And if you are also named then you will get a share out of his property.

If there is a will then property will be divided as per instructions of the will. Sibling will not be entitled to get anything if he is not named in the will.

If you only found out about the will then how are you sure he had one? Basically, I would tell you to find a florida attorney and look into this matter. You may waste time and money but you may not. If I recall correctly in Florida a homestead property would pass to heirs unless spefically stated otherwise in a will. But if you wanted to protest the will or investigate this matter it would be essential to have a Florida attorney.

P.S. Flordia is in the top three states of fraud if not the number one.

Hi Peejo,

I can understand your situation pretty well. Had I been in your situation, I would have surely felt the same. Anyway, you are quite justified in seeking a place in your dad's estate. And, in case, he had left behind a Will, the best person to let you know if your name is in it, is your dad's lawyer. But you need to trace him; your uncle may be the person who knows about him.

However, I doubt whether he'll let you find and talk to him. So, if possible, you can give an advertisement in a Florida newspaper as to who's your dad's lawyer and then probably you will be able to trace him and get to know if at all you have a share of interest in your dad's estate.

Thanks everyone for your replys. I first called my Uncle in Fla. and when I said who I was, he told me that I'd said enough and that I could hang up now. So I called the courthouse and my dads will is 5 pgs. long so I sent $5 to get these copies of his will and the attorneys name I assume will be on that. I've been doing a lot of research online and its helped alot. Thanks.

Your Uncle is certainly not very co-operative but you did the right thing by contacting the local courthouse to get information about your dads will and requesting one copy to review.
