My Mother owned a condo in West Palm Beach, Fl. She passed away in 2008 and left me her condo to me. I was put on the deed in 2006 before she passed but not on the mortgage. I paid the mortgage for one and a half years, but stopped several months ago because I could not afford the payment. I contacted the lender over 60 times and they finally put me in touch with their assumption department who said they would work with me to assume the mortgage at a lower payment, but instead sent it to an attorney for foreclosure. I am dealing with BOA and they bought CW. At the time of the transaction, they lost most of the paperwork and some departments will talk with me and some won't. Palm Beach County has dropped off paper work to the condo, but I am in Maryland. There is no court date yet and the BOA attorney says I am responsible despite not being on the mortgage. Any suggestions?

Hi,

As per my knowledge the lender cannot sue you as you are not on the mortgage. However, if you want to keep the property then you have to re-finance the loan in your name. You can consult with BOA and check if they can offer you an easy re-payment plan or not. Consult with a good attorney to get detailed information.

Just a fyi I am in Michigan and dealing with Chase same issue, my mother in law who is on the mortgage note passed away last july, at that time I was dealing with washington mutual and wanted to do the assumption as the payments were current well then they were bought my chase in october and time after time I would call to be told it would take 30 days well after about 90 days it went to chase and I had to start all over again and as you said some would talk to me and some wouldnt, so I went chase and brought the death certificate and the deed that we had her quit claimed off to show them and the still wouldnt talk to me but a loan officer came over and told me to let the property goal that is was under water this is all so frustrating so now I quit making the payments as my husband is not working nor receiving unemployment benefits due to all that going on so we are just going to sit and wait it out hoping we have some time to get on our own feet anyways good luck and i just was shocked to see someone else going through the same bs!
