My husband passed away in Feb.08. He left no will and he owned (4 lots)property in flordia.

My husband passed away in Feb of this year. We owned 4 lots in Flordia but the deeds are in his name.We had a home in Flordia but I had to sell it in March to pay for his final expenses. I reside in NY now with my grandchildren. Can I sell the property? Does the proceeds go to his estate?

Hi melanie.

Welcome to the forum.

You may not sell the property as long as you don't get the property on your name. As soon as you get the property on your name, you can sell it.

As your husband died without leaving any will, the property will be given to the heirs according to the Intestate Succession Law in your state.
