Do I have to wait 3 months before my ex boyfriend can sign a quitclam deed?

Me and my ex boyfriend bought a house recently in Florida, with me putting down all the down payment. It took a long time to secure. We had been in a long distance relationship for over a year. Just 25 days after closing he told me he no longer wanted to us be together. I am in the Canada. My ex has told me he wants out of the house but cannot sign a quit claim for 4 months as we don't have the title deed yet in the mail?

On the property appraiser website our house is not listed with both our names on it (for property taxes). The public records search shows there is a "special warranty deed". Is this the title deed? Does this mean we can go ahead with the quitclaim? I don't understand why my ex is telling me it will take 4 months. Also, would I need an attorney to draft the quitclaim so it is all legal? I just want to sell up asap, get my down payment back and move on.

My ex is still living in the house that I paid for. Any help with this matter will be much appreciated.

The line should have read "our property IS NOW listed on the website for property taxes" - sorry for the confusion!

Sound like your boyfriend is being sneaky or does not understand. Once you bought the house the ownership was transferred to you and your boyfriend. I would call the title company and verify when they filed the "special warranty deed." Once they have filed the deed it does not matter if you can find it online or not it is of record.

He should be able to sign a quitclaim deed at anytime after deed was recorded. I'm sure the deed has been recorded.

Thank you for your quick reply! the deed has been recorded on the 9th June. It shows this on the public records site. I will call the courthouse/appraiser to see about the best way to go forward from here. Thank you again. yes, unfortunately it is a LONG story about the sneaky part... Sad

Welcome Guest.

I feel you ex-boyfriend can quitclaim to transfer the property to you. so consult with him on that issue. Is the mortgage on your name only? If not then you may also need to refinance the mortgage on your name only.

BTW if you want to sell the property then simply sell it pay off the lender. That will help you save few bucks I hope.
