I signed over a quit deed of a condo in Florida to my ex-husband as a result of a divorce. This was five years ago. As of today, he has not refinanced or made any transaction to take my name off the mortage, and I am still showing on my credit report as a mortgage lein holder.

If he were to pass away, am I still responsbile for this property. How can I find out if he ever filed the quit deed.

You need to check with the county office and see if the quit claim deed was recorded.

Also rememebr even thoguh you singed the quit claim deed you are still responsibel for the loan, until you ex refinaces the mortgage

Hi anidaliar,

If your ex-husband passes away, the lender can sue you for the loan dues. Moreover, if he defaults the loan, your credit can also get badly affected. I hope that you have the divorce papers which asks him to refinance the loan after divorce. You should contact your divorce attorney and take the necessary steps in order to remove your name from the loan docs.
